La Russa “Make more clarity in the Constitution on the boundaries between powers”

ROME (ITALPRESS) – “Some magistrates want to assert their vision of society and politics through jurisdiction. I read that Santalucia says: ours is a progressive Constitution. Actually Catholics, liberals, communists, conservatives wrote it. I understand that he can say it is permeated with an anti-fascist spirit, but it is not progressive.” So says Senate President Ignazio La Russa in an interview with the newspaper La Repubblica. “The right, which wants to govern, would like respect for the prerogatives of politics. And that is why we need to clarify this gray area,” he explains. “Because otherwise it is not clear what the border between the functions of justice and those of politics is. Together, in a concordant way – majority, opposition, magistrates – we have to perimeter these areas. The argument does not work. Who exactly is responsible for defining the roles of politics and justice? To the Constitutional Charter. In the past everything seemed to work. After Tangentopoli it no longer did. There are magistrates who go beyond that, giving the feeling that they are acting with political motives. And there are on the other hand politicians who have a poisoned tooth with judges. If the Constitution does not seem clear enough, it can be made clearer. “Asked whether he proposes a comprehensive reform of Title IV, La Russa replied, “Why not? It might be useful to have a reform that makes the relationship between politics and the judiciary clearer. This is not working”.The ruling that did not validate the transfer of migrants to Albania “can be criticized. It has always happened, on the right as on the left. Nordio called it abnormal. It means: outside the norm,” La Russa added. “The right has always been ‘on the side of the judges.’ Only we have nominated Borsellino to the Hill,” stresses the second highest state office. “We were on the side of Clean Hands, perhaps today we can say: even too much. Respect for the judiciary, which belongs to our history, is not in question.”
