The Garante, with the measure already adopted on 2 October, had previously reported, to the proclaiming subjects, the violation of the legal obligation of notice, provided for by Law 146/90, believing inconferential the recall to article 2, paragraph 7, that previews the possibility to make strikes without notice only “in the cases of abstention from the work in defense of the constitutional order, or protest for serious harmful events of the inco workers”.
