Nordio “EU court ruling on migrants misinterpreted by judges”

ROME (ITALPRESS) – “The ruling of the EU Court was not disapplied by us, but misinterpreted by our judges. The definition of a ‘safe country’ cannot be up to the judiciary, but is an exclusively political assessment albeit within the parameters of international law.” This was stated by Justice Minister Carlo Nordio interviewed by “La Repubblica” on the decision of the judges in Rome who subscribed to the line of the EU Court of Justice on the obligation not to send migrants back to “unsafe” countries. The guardasigilli then goes on to report that “there will be no diktats on safe countries. The matter is being studied in depth. But it is certain that it is not up to the judiciary to confer this license, and the Court’s ruling says precisely that it is up to the state.” “The government does not want to impose a whole lot except the rule of separation of powers. However, yes, the judge must be only the mouth of the law, otherwise he interferes with the legislative power, the expression of the people’s will, to which he is accountable.”
Finally, to the opposition calling for his resignation, he replied:
“They have every right to ask what they believe. Let them do their worst, that we will do our best.”
