ROME (ITALPRESS) – The Budget Law for 2023, in introducing measures to “cool” the automatic revaluation of pensions above four times the minimum Inps amount, did not violate the principles of reasonableness, proportionality and adequacy placed to guarantee pension treatments.This was decided by the Constitutional Court, declaring as unfounded the questions of constitutional legitimacy raised by some regional jurisdictional sections of the Court of Auditors.According to the Court, the legislative mechanism is not unreasonable because it fully safeguards the smallest pensions and, for a limited period, progressively reduces the indexation percentage of all others as the amounts of treatments increase, due to the greater resistance of higher pensions to the effects of inflation.The legislature’s choices are consistent with the economic policy aims, clearly emerging from the preparatory work and legitimately pursued, aimed at countering also the effects of a sudden inflationary push incident especially on the less affluent social classes.Of the losses suffered by pensions not fully revalued, for that matter, the legislature will be able to take into account in the event of any future maneuvers on the indexing of the same treatments.(ITALPRESS).-Photo: Ipa Agency-
