Congressman Di Sanzo submitted a question on the new rules of Italian citizenship

Hon. Di Sanzo has submitted a question to the Minister of the Interior and the Minister of Foreign Affairs and International Cooperation regarding the procedure for the recognition of Italian citizenship iure sanguinis, to ask them to come to the aid of those who have already applied for or are on the waiting list for an appointment for the recognition of Italian citizenship iure sanguinis following the new interpretative lines contained in Circular No. 43347 of Oct. 3, 2024, issued by the Italian Ministry of the Interior, which takes its cue from recent rulings of the Supreme Court.

In fact, the circular clarifies that as a result of the voluntary acquisition of foreign citizenship by an Italian citizen who emigrated before 1992, he loses Italian citizenship, not only the Italian citizen, but also his minor children, and the line of transmission of citizenship is thus considered broken for his children and their descendants.

The circular has raised concerns among experts and citizens, as it is a restrictive interpretation of citizenship regulations, contrary to the current procedure for the recognition of citizenship, reported by the same websites of all Consulates. This new interpretation is creating numerous problems for all those who are waiting for the completion of the process related to such an application made according to the very rules written on the consulates’ websites and often spending a lot of economic resources as well. Since a great number of Italians who emigrated to the United States and Canada acquired the citizenship of the country of emigration when their children were still young, often to avoid phenomena of discrimination, this is a rule that particularly affects the Italian-American and Italian-Canadian community.

For this reason, Hon. Di Sanzo elected in North and Central America with the Democratic Party has asked the government to safeguard the rights of those who have already started the paperwork for such recognition, according to the previously established rules, whether the paperwork is on the waiting list or has already been started at the consular offices, even assuming a transitional period that would allow the current or waiting list proceedings to finish the prescribed process. Hon. Di Sanzo hopes there will be reasonableness and that these requests will be granted in order to avoid changing the rules while so many recognition procedures have already been started and are still ongoing.
